Registration Of Sole Proprietor Or Partnership
In Malaysia, registration for a sole proprietorship or partnership is exclusively available to Malaysian citizens or Permanent Residents aged 18 and above. The registration process is quick, typically completed within an hour, allowing you to start your business immediately!
It is important to note that the nature of the registered business must comply with all applicable laws and must not be intended for any unlawful activities or purposes that could jeopardize the security of the Federation, public order, or morality.
1. Document you need to prepare
Photocopy of the owner’s and/or partner’s Identity Card (IC).Permit, license, approval, or supporting letter for specific business types (if required), such as:
- Nursery: Department of Social Welfare
- Kindergarten, Tuition Centers, Schools/Colleges: Ministry/Department of Education
- Other relevant agencies, as specified by the Registrar of Business.
Cash for registration fees (RM60–RM100):
- Sole proprietorship using the personal name (as per IC): RM30
- Sole proprietorship or partnership using a trade name: RM60
- Registration of branches: RM5 per branch
- Business information printout: RM10

2. Registering a Business: Personal Name or Trade Name Options
A business name can be registered in two ways:
- Using a Personal Name as per the Identity Card
Examples:
- Zamarul bin Johan
- Zhang Wei Fong
- Tamilselvam a/l Muthusamy
- Using a Trade Name
A trade name refers to the proposed business name that requires prior approval from the Registrar of Business.
Examples:
- Kedai Coffee
- Zafrul Catering
- Mega Top Enterprise
To register your business name:
Once approved, the selected name will be attached to the New Business Registration Form (Form A) at the registration counter.
Complete the Business Name Approval Form (Form PNA.42) with three (3) proposed business names.
Business names will be reviewed and approved based on priority.
3. How to Complete the Business Registration Form (Form A)
- Business name
- Commencement date of business
- Principal place of business
- The address of the branch of business (if any)
- Information of owner and partners
- Type of business carried out
- Provide a copy of the Partnership Agreement (if any)
4. Sign The Completed Form
Every business owner and partner must sign the completed form.
5. Submitting Your Application
The responsible person must submit the application either at the counter or online via SSM’s e-Lodgement services, available on SSM’s official website at www.ssm.com.my
6. Validation
A new business registration is valid for a period of 1 year and can be renewed for up to a maximum of 5 years for each registration.
7. Get Your Certificate
The Business Registration Certificate can be obtained within 1 hour from the time payment is made. If you register online, you will receive your certificate once SSM approves your registration.
8. What Happens If You Don’t Register Your Business
A person who operates a business without registering it commits an offense under the ROBA 1956. If found guilty, the individual may be fined up to RM50,000, imprisoned for a term not exceeding 2 years, or both.
9. Obtaining Licenses, Permits, and Approval Letters
Even if a business is registered with SSM, business owners are still responsible for obtaining any necessary licenses, permits, or approval letters from other relevant authorities in order to operate their businesses.
